Any Item you purchase from CINEMACAMERAS.COM (including through Trade-in) is covered by a two day limited warranty (the “Warranty”), unless otherwise stated. Items sold for spares/repairs in a stated faulty condition are excluded from our Limited Warranty. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
This Limited Warranty extends to Items purchased directly from CINEMACAMERAS.COM. Items sold on the Platform for spares/repairs in a stated faulty condition are excluded from our Limited Warranty. This Warranty does not cover your Item if you use it in a manner incompatible with its intended use.
This Limited Warranty extends to the purchaser of an Item from CINEMACAMERAS.COM. All CINEMACAMERAS.COM warranties, including any implied warranties, are valid only for the period of time the Item is owned by such purchaser. The “purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the Item from CINEMACAMERAS.COM. Please retain a copy of your receipt as proof of purchase. This Limited Warranty is not transferable.
CINEMACAMERAS.COM warrants the Item in the packaging sold to you against the defects in material and workmanship set forth below (“Defects”) for two days from the time the Item is initially purchased by you, solely when the Item is used normally for its intended purposes. If you obtain a replacement Item through this Limited Warranty, the Limited Warranty for such replacement Item will only last for the remaining duration of the two day period that began with the original purchase.
This Limited Warranty extends to Items purchased through the CINEMACAMERAS.COM website (the “Warranted Products”). This Limited Warranty does not extend to any product that is not obtained through the CINEMACAMERAS.COM platform (including, without limitation, any non-CINEMACAMERAS.COM product that is attached to or used in connection with the Warranted Product).
In the event of a Defect, CINEMACAMERAS.COM’ sole and exclusive liability and your sole remedy under this Limited Warranty will be, at CINEMACAMERAS.COM’ option, to provide a repaired or replacement Item, subject to your fulfillment of “Your Responsibilities” below.
This Limited Warranty does not cover:
In the event of a Defect and in order to get the benefit of this Limited Warranty, you must return your Item to CINEMACAMERAS.COM and provide CINEMACAMERAS.COM with proof of the original date of purchase. In order to return your Item, you must email CINEMACAMERAS.COM at info@cinemacameras.com or call +1 424-226-3727 to obtain a Return Authorization Number. If you are not able to speak to a representative over the phone, you must email us at info@cinemacameras.com within this warranty period. Should shipping costs be required to return your Item and only if you are located within the United States, CINEMACAMERAS.COM will cover these costs by providing a shipping label for a courier service chosen by CINEMACAMERAS.COM. You would be responsible for any packaging costs when returning the Item under warranty. Shipping costs for warranty claims will not be covered by CINEMACAMERAS.COM if you are located outside of the United States. Evidence of a Defect and any claims must be sent to the address set forth at the end of this Limited Warranty.
CINEMACAMERAS.COM will repair your Item or replace Item with a like-for-like model in like-for-like condition (as applicable) and ship your Item back to you. CINEMACAMERAS.COM will be responsible for the shipment back to you of any repaired Items, as long as you are located within the United States. To the extent permitted by applicable law, the foregoing shall be your exclusive remedy and CINEMACAMERAS.COM’s sole liability for a claim related to a Warranted Product under this Limited Warranty.
TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, ITEMS ARE PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES WITH RESPECT TO THE WARRANTED PRODUCTS AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, IN NO EVENT WILL CINEMACAMERAS.COM OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE ITEM OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF CINEMACAMERAS.COM HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. CINEMACAMERAS.COM’ TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE ITEM GIVING RISE TO SUCH LIABILITY.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
This Limited Warranty will be governed by the laws of the State of New York, without regarding to conflicts of law principles that would require the application of another jurisdiction’s laws.
